1. Overview

Not For Lazy Moms (“NFLM”) enjoys giving away prizes provided by product donors in a random drawing held monthly. Each Giveaway will be announced in a post on the Not For Lazy Moms website (each, a “Giveaway Post”).

2. Sponsor

The NFLM Giveaway (“Giveaway”) is sponsored by Not For Lazy Moms, LLC 9812 Falls Road, Suite 114-226, Potomac, MD 20854 (“Sponsor”). All decisions of the Sponsor are final and binding.

3. Prize

The prize referenced on the Giveaway Post (“Prize”) will be awarded to one eligible individual (“Winner”) pursuant to these rules (“Official Rules” or “Rules”). The start and end dates and times of the Giveaway will be specified in the Giveaway Post.

4. Entry Period

Each Giveaway begins on the 15th day of each month at 12:00:00 AM Eastern Time and ends at 11:59:59 AM Eastern Time on the last day of the month announced in the Giveaway Post, unless otherwise stated on the Giveaway Post (“Entry Period”). For purposes of the Giveaway, Eastern Time on any particular day shall mean the applicable local time in Washington, District of Columbia on that day.

5. How & When to Enter

To enter the Giveaway, an individual must already be an NFLM subscriber, and must submit a complete and accurate entry form (“Entry”). To become an NFLM subscriber, navigate to the NFLM main page, and under the heading titled “Subscribe,” provide all requested information, and click the button labeled “Subscribe.” To complete the subscription process, you must follow all directions in, and affirmatively respond to, the NFLM confirmation email. To prepare an Entry, navigate to the Giveaway Post and click on “ENTER FOR A CHANCE TO WIN” (“Entry Page”). Follow the instructions on the Entry Page, fill in all requested information, and click the button labeled “Done” to submit the Entry Form. An Entry is not official until your complete and accurate entry form has been received by the Sponsor during the Entry Period. Limit one (1) Entry per subscriber per Giveaway. Each Giveaway is a different drawing.

6. Eligibility

Individuals must be current subscribers of NFLM (“Subscribers”) and Sponsor must have received the individual’s Entry prior to the end of the Entry Period in order to be eligible for the Giveaway. The Giveaway is available to individual legal residents of the United States with a mailing address in one of the 50 States or the District of Columbia, that are 18 years of age or older, and are subscribed to be a NFLM member at the time of entry and Winner Selection (“Entrant”). To be eligible, Entrant must use in the Entry Form the same email address with which they are presently subscribed as a member of NFLM. Individuals that are current or former employees or suppliers, representatives, or agents of the Sponsor or any of its respective parent companies, subsidiaries, affiliates, or agencies, and/or members of their households, are not eligible to enter. Individuals that are current or former employees or suppliers, representatives, or agents of the donor of the prize (“Prize Donor”) or any of its respective parent companies, subsidiaries, affiliates, or agencies, and/or members of their households, are not eligible to enter. Sponsor reserves the right to require proof of eligibility.

7. Winner Selection & Notification

The Sponsor or its designated representative(s) will pick the winner of the Giveaway by a random drawing of all eligible entries received throughout the Entry Period (“Selection”). The Selection will be conducted within the first seven (7) days of the month following the Entry Period by the Sponsor or its designated representative(s), whose decision is final. The eligible Entrant whose Entry is drawn through the Selection (“Potential Winner”) will be notified within seven (7) days of Selection via the email address associated with that individual’s NFLM account (“Prize Notification”). Potential Winners must continue to comply with the Official Rules. In order to claim the Prize, the Potential Winner must follow the instructions provided by the Sponsor at the time of the Prize Notification and verify their mailing address and any other personal information required for the Sponsor to issue the prize, within seventy-two (72) hours of the Prize Notification. Winning is contingent on fulfilling all requirements and following all of the Sponsor’s directions. At the time of the Prize Notification, Potential Winner will also be required to provide an eligible shipping address within the United States. Failure to claim the prize within the prescribed time, or failure to follow any of the directions, or provide an eligible shipping address, will result in disqualification of the Potential Winner and an alternate Entry may be selected at the Sponsor’s discretion. The Sponsor may provide third parties with Winner’s contact information for purposes of Prize fulfillment and delivery, or for promotional purposes. The authorized subscriber of the email account used to create the NFLM account at the time of entry into the Giveaway will be deemed to be the Entrant. The authorized subscriber is the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail address.

8. Prize Details and Restrictions

The Prize(s) to be awarded and the Approximate Retail Value of the Prize(s) is/are listed on the Giveaway Post: https://notforlazymoms.com/may-giveaway-2019/. Odds of winning will depend upon the total number of eligible entries received. Any difference between the Approximate Retail Value of the Prize as listed on the Giveaway Post and the actual value will not be awarded in any form. Expenses not explicitly included in the Prize description on the Giveaway Post and all taxes are the sole responsibility of the Winner. Winner may receive a gift card or voucher redeemable for the Prize. Gift cards and vouchers are subject to certain restrictions, including, but not limited to, expiration dates. The Prize is non-transferable, non-assignable, non-exchangeable, and not redeemable for cash or any other thing of value.

9. General Rules & Disclaimers

By entering, each Entrant agrees to be bound by Not For Lazy Moms LLC’s Terms of Use and Privacy Policy and these Official Rules. Entrant agrees that Sponsor has the sole right to decide all matters and disputes arising in any way from the Giveaway and that all decisions of the Sponsor are binding and final. Sponsor reserves the right to modify, terminate, postpone, or cancel a Giveaway at any time for any reason. Sponsor reserves the right to amend the Official Rules as it deems necessary. Sponsor is not responsible for: non-conforming, late, misdirected or unintelligible or any inaccurate entry information, whether caused by the Entrant, third parties, including Internet service providers, web browsers, or any of the equipment or programming associated with or utilized in the Giveaway, including but not limited to: interruptions in or unavailability of services, delayed or filtered communications or transmissions, or malfunctions in any computer, digital device, or other equipment hardware or software, including any other technical or human error that may occur in the processing of entries. Sponsor is not responsible for any injury or damage to your computer or any other device resulting from downloading or accessing any materials in connection with the Giveaway. Sponsor is not responsible for any printing of typographical errors in any materials associated with a Giveaway. Proof of entry does not constitute proof of receipt. Sponsor is not responsible for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the Potential Winner. If, despite a good faith effort, Sponsor is unable to confirm the Winner prior to any Prize expiration date or Prize availability period stated in these Official Rules or otherwise, Sponsor reserves the right not to award the Prize or to donate it to an appropriate charity. Sponsor also reserves the right not to award the Prize if the Winner cannot be confirmed after a good faith effort to do so.

10. Release of Liability and Publicity

EACH PRIZE IS AWARDED “AS-IS” AND THE SPONSOR MAKES NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHETHER NOW KNOWN OR HEREINAFTER ENACTED. SPONSOR IS NOT RESPONSIBLE OR LIABLE FOR DEFECTS OF ANY KIND OR DAMAGE TO THE PRIZE SUSTAINED DURING SHIPPING. Sponsor has no obligation to a Winner or Potential Winner that is unable or unavailable to accept or utilize the Prize. Winner or Potential Winner may be required to sign and return an Affidavit of Eligibility, a Liability release, and, where legally permissible, a Publicity Release, within seventy-two (72) hours following the date of attempted Prize Notification. Failure to comply with this deadline may result in forfeiture of the Prize and selection of an alternate Winner. Return of any Prize or Prize Notification as undeliverable may result in disqualification and the selection of an alternate Winner at the discretion of the Sponsor. By entering, Entrant grants permission for Sponsor, and any of its affiliates and subsidiaries, participating advertising and promotion agencies, and Prize suppliers or manufacturers, to use personal information provided by Entrant to Sponsor for editorial, advertising and promotional purposes without additional compensation, unless prohibited by law. Acceptance of the Prize constitutes permission for Sponsor and any of its affiliates and subsidiaries, participating advertising and promotion agencies, and Prize suppliers or manufacturers, to use Entrant’s personal information and likeness and biographical information for editorial, advertising and promotional purposes in any media without additional compensation, unless prohibited by law. By entering, Entrant agrees to release, discharge, indemnify and hold harmless the Sponsor and its affiliates, subsidiaries, representatives, employees, officers, directors, agents, and advertising and promotion agencies for any and all claims, causes of action, demands, losses or liabilities, or any injury or damage, including claims based on publicity rights, defamation, invasion of privacy, property damage, or personal injury and/or death, caused or claimed to be caused directly or indirectly from participation in the Giveaway or acceptance or use/misuse of the Prize, even if caused by Sponsor. In the event a third party provides the Prize, Entrant agrees to not hold Sponsor responsible for all issues stated in this Section that may arise between the Winner and that third party. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing, publishing, or promotion of the offer, administration of the Giveaway or in the announcement of the Prize. Sponsor does not endorse any recommendations, advice, claims, opinions, or editorial content made by the Prize supplier or manufacturer. Images or statements portraying the Sponsor or any of its affiliates and subsidiaries operating or appearing with a Prize does not constitute endorsement.

11. Disqualification

Sponsor reserves the right, at its sole discretion, to disqualify any person it believes has violated these Rules or unfairly tampered with any aspect of the Giveaway. This includes, but is not limited to, individuals found to be: (a) tampering with the entry process or tampering with any operation of the Giveaway, the website, or subscription registration; (b) using robotic, automated, or programmed entry methods, including but not limited to the creation of entries generated by script or macro (or similar entry methods); or (c) acting in any unsportsmanlike manner, as determined by the Sponsor. Any person that attempts to undermine the legitimate operation of the Giveaway may be in violation of criminal and civil law, and the Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.

12. Miscellaneous

No purchase is necessary to enter the Giveaway. Chances of winning depend on the number of eligible entries received. All federal, state and local laws apply. Void where prohibited by law. By entering into the Giveaway, Entrant agrees to be bound by these Rules. This agreement is governed by the laws of the State of Maryland without giving effect to any choice of law or conflict of law rules. ENTRANT AGREES THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF ANY ELEMENT OF THE GIVEAWAY OR THE PRIZE SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY STATE OR FEDERAL COURTS LOCATED IN THE STATE MARYLAND. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway, but in no event attorneys’ fees.
